1. ABOUT THRESHOLD SOCEITY, INC. ("THRESHOLD SOCIETY"): *

Threshold is a membership-based, volunteer-supported, social club organization that sponsors educational events, support groups, and social gatherings with an emphasis on education, safety, and inclusivity. It is certainly not one of the primary purposes of the Threshold to allow, facilitate, and/or provide facilities for its members or guests to engage in any high-risk sexual contact while at any of its events. By signing this document, the undersigned acknowledges the risks involved in such contact. Threshold is not intended to be, and in fact does not operate as, a Commercial Sex Venue. The undersigned further is aware of the free condoms provided by Threshold in connection sexual activities, if any.

2. DISCLOSURE OF RISK: *

I am fully aware of the nature, purpose, and activities of Threshold as an organization involved in activities relating to the transfer of power within the context of alternative lifestyles and issues of personal health and safety relating thereto. I acknowledge that some of those activities may involve the risk or potential for injury or damage. I hereby apply for membership at Threshold and seek to participate in Threshold activities with full knowledge and appreciation of the potential or risk of injury and damage inherent therein.

3. ASSUMPTION OF RISK: *

As consideration for being allowed to obtain membership in Threshold, I knowingly, intelligently, and voluntarily assume any and all risk of any and all personal injury or damage which may arise directly or indirectly, or may, in any manner whatsoever, be related to any Threshold activity or event. I acknowledge that participating in “play” as referred to in the “Threshold Party Etiquette Rules” risks injury. With that knowledge and understanding, I assume all risk of any such injury of any nature or kind whatsoever. I hold harmless, release and indemnify Threshold, its managers, employees, agents, predecessors, and successors in interest, heirs, assigns, and attorneys, and indemnify each of them from and against any and all loss, claim, cause of action, lawsuit, damage, liability, demand, claim of right or action, or expense whatsoever which I have or may allege against any of them arising out of or in connection with any such participation in any such play. I accept full responsibility for my own health, safety, and expressly assume all risk of any harm whether or unforeseen, and howsoever occurring in, at or from said play at Threshold. I further covenant not to sue or make any demand or claim against Threshold or other parties released herein for or by reason of any damage or injury to me as described herein.

4. WAIVER OF LIABILITY *

In consideration of being granted membership in Threshold and participation in its events, I hereby waive, release, and hold harmless the Threshold Society, Inc. and its directors, officers, members, shareholders, affiliates, predecessors, and successors from and against any and all claims for and any and all injuries (personal, property, or otherwise), damages, costs, expenses, and liabilities for bodily injury of any nature or kind whatsoever, death, property damage of any nature or kind whatsoever arising directly or indirectly or in any manner related to my attendance at or participation in any Threshold activity or event.

5. AGREEMENT TO ARBITRATE DISPUTES: *

As further consideration for being allowed to obtain membership and participate in Threshold, I hereby agree that any and all disputes which may arise between me and Threshold or any of its directors, officers, affiliates or members arising from my membership and/or participation in Threshold will be submitted to binding arbitration before and under the rules of the American Arbitration Association, each party to pay one-half of the cost of such arbitration, and each party agreeing to be bound fully and finally by the decision of such arbitrator in lieu of a jury or court trial.

6. BINDING ON HEIRS & ASSIGNS: *

This agreement is binding upon me, my heirs and assigns, estate and all other persons who may claim by or through me in the event of my injury or death.

7. UNKNOWN CLAIMS *

The undersigned acknowledges and agrees that the release herein applies to all claims for injuries, damages, or losses to person and property, real or personal (whether those injuries, damages or losses are known or unknown, foreseen or unforeseen, or patent or latent) and that the undersigned may have against the Threshold Society, Inc. The undersigned certifies that he/she/they has read and waives the following provisions of the California Civil Code §1542: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES KNOW OR SUSPECT TO EXIST IN HIS/HER/THEIR FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM/HER/THEM MUST HAVE MATERIALLY AFFECTED HIS/HER/THEIR SETTLEMENT WITH THE DEBTOR.” The undersigned understands and acknowledges that in consequence of this waiver of California Civil Code §1542, even if he/she/they should eventually suffer additional damages arising out of the matters referred to herein, he/she/they will not be able to make any claim for those damages. Furthermore, the undersigned acknowledges that he/ she/they intends these consequences even as to claims for damages that may exist as of the date of this release, but he/she/they does not know exist, and that, if known, would materially affect his/her/their decision to execute this release, regardless of whether his/her/their lack of knowledge is the result of ignorance, oversight, error, negligence, or any other cause.

1. CONSENT: *

All activities are agreed upon in advance by all parties involved, and participants are consenting adults. Members and guests will respect as final the decision of anyone not to participate in any activity.

2. CONFIDENTIALITY: *

All information about the identities and activities of Threshold Members and guests is held in the strictest confidence by all Members and Guests, including telephone numbers, addresses and all other personal information.

3. DRUGS OR ALCOHOL: *

Cannabis, alcoholic beverages and illegal drugs are NOT allowed at Threshold events. Possession of illegal drugs or being intoxicated at any Threshold event may be cause for eviction from the event and revocation of your membership.

4. SEX: *

Most types of non-high risk sexual contact and expression are permitted at member only events. High risk sexual behavior (genital to genital and oral to genital contact) is prohibited at some events. It is up to you to confirm sexual contact rules with a DM or Board member prior to engaging in high risk sexual behavior if you are unsure of the event rules.

5. SAFETY: *

All activities must be performed in a safe, sane and consensual manner. The decision of the Threshold Director (Board Member) and appointed representatives is final. Please refer to your copy of “Threshold Club Rules and Party Etiquette” for more detailed information.

6. NO COMMERCIAL SOLICITATION: *

No member or guest may offer or request any sexual or other services for money, property or anything of value at a Threshold event. Any member aware of such activities must bring them to the attention of the Threshold Director (Board Member) immediately.

7. CAMERAS OR RECORDING DEVICES *

Unless approved by the Threshold Director (Board Member) or Dungeon Monitor, cameras or any other recording devices cannot be brought to or used at a Threshold event. Cell phones may only be used in strict accordance with Threshold policies.

8. GUEST POLICIES: *

Members may bring a maximum of three Guests to Threshold events. Members are responsible to ensure that their Guests both understand and observe all Threshold rules. You must sign guests in at the front and they must leave when you leave.

9. EXPIRATION GRACE PERIOD / ORIENTATION: *

My membership has not been expired for more than two years. If expired for more than two years, I have attended an orientation within the last 90 days.
